The arbitration shall be heard in front of a panel of one arbitrator. The arbitration hearings shall be held in Fairfax County, Virginia. You and WP agree to arbitrate in each of our individual capacities only, not as a representative or member of a class, and each of us expressly waives any right to seek relief on a class basis. The arbitrator’s award shall be binding upon both parties and may be entered as a judgment in any court of competent jurisdiction. The prevailing party shall be entitled to recover from the other party the expenses for the arbitrator’s fee’s, attorney’s fees.

Jurisdiction: For any dispute found to not be subject to binding arbitration set forth in this Terms of Use, you and we agree to submit to the personal and exclusive jurisdiction of and venue in the federal and state courts located in the State of Virginia, County of Fairfax. You agree to accept service of process by mail and waive all jurisdictional and venue defenses otherwise available.

13. Modification and/or Termination: We reserve the right to terminate this Terms of Use at any time. We reserve the right to modify or replace any part of this Terms of Use at any time by posting a notice on the website or by sending you notice via e-mail. The most recently modified Terms of Use will govern your use of this website.
