Binance Plans New EU License Application Under MiCA Regulation

BusinessBinance Plans New EU License Application Under MiCA Regulation

Cryptocurrency exchange Binance has stated its intention to remain in the European Union and will pursue a new application for an operating license, according to a senior executive. The announcement follows the company’s failure to secure approval under the EU’s new Markets in Crypto-Assets (MiCA) regulatory framework.

In a statement to Reuters, a senior Binance executive confirmed the company plans to make a new push for authorization to operate within the 27-nation bloc. The company’s initial application under the MiCA regime was not successful, a development that affects its ability to provide services to its users in the region once the new regulations take full effect.

The MiCA regulation, passed by the EU, establishes a unified legal framework for crypto-assets across all member states. It is designed to replace the previous system where companies sought individual licenses in different countries. The new rules aim to standardize consumer protection, prevent market manipulation, and ensure financial stability related to digital assets.

Under the new framework, crypto-asset service providers must obtain a license from a national regulator in one EU member state, which can then be “passported” to operate across the entire union. Without a MiCA license, companies will be unable to legally offer most crypto-related services to EU residents.

Binance had previously secured registrations with national authorities in several EU countries, including France, Italy, and Spain. However, the MiCA legislation requires all firms, including those with existing national permits, to transition to the new, more comprehensive licensing standard.

The company has faced regulatory scrutiny in several jurisdictions. It has previously withdrawn from markets such as the Netherlands after failing to obtain regulatory approval and has also deregistered in Cyprus.

The executive who spoke with Reuters did not specify the reasons for the initial application’s failure or provide a timeline for the new submission. The process of complying with MiCA is a significant step for all crypto firms wishing to maintain or establish a presence in the European Union, which represents a substantial market for digital asset services. The outcome of Binance’s next application will determine its legal standing to operate in the region under the new regulatory regime.
